These Terms and Conditions (“Terms”) govern your access to and use of the SPORTSKIND website, leagues, programs, events, and related services (the “Services”). The Services are operated by ProPlay Texas Holdings, LLC, doing business as SPORTSKIND (“SPORTSKIND,” “we,” “us,” or “our”), located at 2015 S IH 35 Frontage Rd, Suite 102, Austin, TX 78741.

By using our website, registering for a league or event, or signing up to receive messages from us, you agree to these Terms. If you do not agree, please do not use the Services.

1. Who can use the Services

Our leagues and events are intended for adults. You must be at least 18 years old to register, create an account, or make a purchase. By registering, you confirm that the information you provide is accurate and that you are legally able to enter into these Terms.

2. Accounts and registration

Some Services require you to create an account or register through our registration partner. You are responsible for keeping your login details secure and for all activity that happens under your account. Let us know right away if you believe your account has been used without your permission.

3. Payments

Prices for leagues, tournaments, and events are listed on each program page. Payment terms vary by program:

• For most leagues, you may place a deposit to hold your team’s spot, with full payment due before your first game as stated on the program page.
• Free agent registrations require full payment at the time of registration.
• You are responsible for any fees charged by our third party payment processor.

We may change pricing at any time, but changes will not affect registrations you have already completed.

4. Refunds and cancellations

To be eligible for a refund, you must request it at least 14 days before the start of your league or event. Refunds are subject to a processing fee as stated at the time of registration. Any exceptions to this policy will be listed on the individual program page. If SPORTSKIND cancels a program outright, we will provide a refund or credit as appropriate.

5. Code of conduct

All participants, coaches, and spectators are expected to show good sportsmanship at all times. We enforce a zero tolerance policy for abusive behavior. Any verbal or physical abuse toward officials, staff, participants, or spectators may result in removal from the facility and possible suspension. Decisions of league staff and officials are final.

6. Assumption of risk and waiver

Participation in sports and physical activity involves inherent risks, including the risk of injury. By participating in any SPORTSKIND league, event, or activity, you acknowledge these risks and agree to participate at your own risk. You may be required to sign a separate waiver and release of liability before participating. To the fullest extent permitted by law, you release SPORTSKIND from claims arising out of your participation.

7. Mobile messaging (SMS) terms

These mobile messaging terms apply if you opt in to receive text messages from SPORTSKIND.

Program description. When you provide your mobile number and opt in, SPORTSKIND may send you recurring text messages related to your participation, such as league reminders, schedule changes, game and field updates, registration and account notifications, and occasional program announcements.

Opting in. You opt in by providing your mobile number and agreeing to receive messages, for example by checking the consent box on our sign up form or during registration. Consent to receive text messages is not a condition of registering for or purchasing any SPORTSKIND program.

Message frequency. Message frequency varies depending on your activity and the programs you join.

Cost. Message and data rates may apply. These charges come from your mobile carrier and are your responsibility.

Opting out. You can cancel text messages at any time by replying STOP to any message you receive from us. After you reply STOP, we will send one confirmation message and then stop sending texts. To start receiving messages again, you can opt in as you did the first time.

Help. For help, reply HELP to any message from us, or contact us at team@sportskind.com.

Carriers. Mobile carriers are not liable for delayed or undelivered messages.

Your privacy. We will not sell, rent, or share the mobile number or text messaging consent information you provide with any third parties or affiliates for their own marketing or promotional purposes. 8. Intellectual property

The SPORTSKIND name, logo, website content, and program materials are owned by SPORTSKIND or its licensors and are protected by law. You may not copy, reproduce, or use them without our written permission, except as needed to use the Services normally.

9. Third party services and links

Registration, payments, and messaging may be handled by third party providers, and our website may link to other websites we do not control. We are not responsible for the content, policies, or practices of those third parties. Their terms and privacy policies apply when you use their services.

10. Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non infringement. We do not guarantee that the Services will be uninterrupted, error free, or secure.

11. Limitation of liability

To the fullest extent permitted by law, SPORTSKIND and its owners, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Services or participation in any program. Where liability cannot be excluded, our total liability is limited to the amount you paid to us for the program giving rise to the claim.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date above. Changes take effect when posted. Your continued use of the Services after changes are posted means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Any disputes will be handled in the state or federal courts located in Travis County, Texas.
